1. INTRODUCTION

These Terms & Conditions ("Terms") govern your access to and use of www.kaalvoid.com ("Website") and your purchase of products offered through the Website.

By accessing the Website, creating an account, placing an order, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and the policies incorporated into them.

If you do not agree with these Terms, please do not use the Website or place an order.

2. DEFINITIONS

For purposes of these Terms:

"KAALVOID", "we", "us", or "our" means NDS Digital Private Limited, operating the KAALVOID brand and Website.

"Customer", "User", "you", or "your" means any person who accesses the Website, browses its content, creates an account, places an order, or otherwise interacts with KAALVOID.

"Website" means www.kaalvoid.com and any related pages, interfaces, or digital services operated by KAALVOID.

"Products" means clothing and other merchandise offered for sale by KAALVOID through the Website.

"Order" means a request submitted by a Customer to purchase one or more Products through the Website.

"Policies" means these Terms & Conditions and the separate Privacy Policy, Shipping Policy, Refund, Return & Exchange Policy, Cancellation Policy, and any other policy published by KAALVOID from time to time.

"COD" means Cash on Delivery, including any partial COD arrangement offered by KAALVOID.

"RTO" means Return to Origin, where an order is returned to KAALVOID because it could not be successfully delivered or was refused/returned by the Customer.

3. ELIGIBILITY

By using the Website or placing an order, you represent that you are legally competent to enter into a binding agreement under applicable Indian law.

If you are under 18 years of age, you may use the Website only with the involvement and consent of a parent or legal guardian, where required by applicable law.

KAALVOID reserves the right to restrict or cancel transactions where information provided by a Customer is materially false, misleading, fraudulent, or otherwise unlawful.

4. WEBSITE USE

You agree to use the Website only for lawful purposes.

You must not:

Attempt to gain unauthorised access to the Website, servers, systems, or customer data.
Interfere with the security or functioning of the Website.
Use automated systems, bots, scraping tools, or similar methods to extract Website content without prior written permission.
Impersonate KAALVOID, NDS Digital Private Limited, its employees, representatives, or another person.
Use the Website to commit fraud or facilitate unlawful activity.
Submit false reviews, ratings, testimonials, or transaction information.
Copy, reproduce, distribute, or commercially exploit KAALVOID content without authorisation.
Upload or transmit malicious software, viruses, or other harmful code.

KAALVOID may restrict, suspend, or terminate access to the Website or an account where there is a reasonable basis to believe that these Terms or applicable law have been violated.

5. PRODUCT INFORMATION

KAALVOID makes reasonable efforts to ensure that product descriptions, photographs, specifications, sizes, colours, prices, and other product information displayed on the Website are accurate.

However, minor differences may occur due to:

Lighting and photography conditions.
Screen or display settings.
Manufacturing tolerances.
Natural variations in fabric, printing, washing, or finishing processes.

Such minor variations do not automatically constitute a product defect.

Product-specific information shown on the relevant product page will apply to that Product.

Baby tee / fitted silhouette
HD printing, screen printing, or DTG printing depending on the design

The specific printing technique and product finish applicable to a Product will be indicated or otherwise communicated for that Product where relevant.

6. PRICING

All Product prices displayed on the Website will be in Indian Rupees (INR).

Applicable taxes and other charges will be displayed as required at the relevant stage of purchase.

KAALVOID reserves the right to change prices, discounts, promotional offers, or Product availability at any time.

Such changes will not affect an order that has already been validly accepted and processed, except where cancellation is permitted under these Terms or applicable law.

In the event of an obvious pricing or technical error, KAALVOID may cancel the affected order and provide the applicable refund.

7. ORDERS

Submitting an order through the Website constitutes a request to purchase the selected Products.

An order acknowledgement or confirmation of order receipt does not necessarily mean that the order has been finally accepted.

Orders remain subject to:

Product availability.
Payment confirmation.
Address and serviceability verification.
Fraud or risk checks where applicable.
Other reasonable order-validation procedures.

KAALVOID reserves the right to decline or cancel an order where there is a genuine stock, pricing, technical, payment, fraud, or serviceability issue.

Where an order is cancelled by KAALVOID after payment has been received, the applicable refund will be processed in accordance with the Refund, Return & Exchange Policy and applicable law.

8. PAYMENT

KAALVOID may offer prepaid payment methods and partial COD for eligible customers, locations, products, or orders.

Available payment methods may vary depending on location, order value, risk checks, and other operational factors.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payment processing may be handled by third-party payment service providers. KAALVOID does not control the internal systems of those providers and will process payment-related information in accordance with its Privacy Policy and applicable arrangements with service providers.

9. COD TERMS AND REPEATED COD REFUSALS

Where partial COD is offered, the applicable partial COD amount or charges will be displayed before the order is completed.

A Customer may refuse a COD order at the time of delivery.

However, where a Customer has paid partial COD charges or express shipping charges, those charges will not be refundable merely because the Customer refuses or does not accept the order, subject to applicable law and the applicable policy.

Repeated COD cancellations/refusals

Repeated COD cancellations, refusals, or non-acceptance of orders may result in KAALVOID restricting or removing COD eligibility for that Customer.

After approximately 2–3 COD cancellations or refused deliveries, KAALVOID may require future orders from that Customer to be placed on a prepaid basis only.

Where a Customer subsequently places a COD order after repeated cancellations, KAALVOID may contact the Customer to verify the order and request full payment before dispatch.

The order will be dispatched only after the required payment is successfully received.

If the requested payment is not completed, KAALVOID may cancel the order.

This system is intended to reduce repeated failed deliveries and RTO-related operational losses.

10. ORDER CANCELLATION

Prepaid Orders

A Customer may request cancellation of a prepaid order within 24–48 hours of placing the order, provided that the order has not already been dispatched.

Once an order has been dispatched, it cannot ordinarily be cancelled through a cancellation request.

After dispatch, an eligible size issue may be handled through the applicable Size Exchange process.

Change of Mind

KAALVOID does not accept returns or cancellations solely because a Customer changes their mind, dislikes the product after purchase, or no longer wants the Product, subject to any rights that cannot legally be excluded.

11. SIZE EXCHANGE

KAALVOID may provide a size exchange for an eligible Product, subject to:

The request being made within the applicable return/exchange period.
The requested replacement size being available.
The Product remaining unused and in its original condition.
The hand tag remaining attached and not removed.
All applicable original tags, packaging, and other required items being retained.

A size exchange does not automatically entitle the Customer to a cash refund.

12. RETURNS AND REFUNDS

KAALVOID's return and refund rules are governed by the separate Refund, Return & Exchange Policy.

In general, eligible returns may include situations such as:

Receipt of the wrong Product.
Receipt of a defective or damaged Product.
Other circumstances expressly covered by the Refund, Return & Exchange Policy.

Change-of-mind returns are not accepted.

Where a refund is approved, KAALVOID will process the refund to the original payment method, subject to applicable payment processing timelines and the applicable Refund, Return & Exchange Policy.

Customers should review the separate policy before placing an order.

13. SHIPPING AND DELIVERY

KAALVOID currently ships within India.

International shipping may be introduced by KAALVOID at a later stage.

Orders are generally dispatched within 2–3 working days after successful order processing, subject to product availability, verification, holidays, operational circumstances, or other reasonable delays.

Delivery time depends on the Customer's location and the shipping service selected.

Where express shipping is available and selected by the Customer, the order may reach the destination faster than standard shipping.

Delivery estimates are indicative and may vary due to courier operations, weather, holidays, remote locations, force majeure events, or circumstances outside KAALVOID's reasonable control.

The detailed shipping rules are provided in the Shipping Policy.

14. RTO / FAILED DELIVERY

An order may become RTO where delivery cannot be completed because of circumstances such as:

Incorrect or incomplete delivery information.
Customer unavailable at the delivery address.
Customer refusing to accept the order.
Repeated delivery attempts failing.
Customer-requested refusal.
Other circumstances resulting in non-delivery.

Repeated RTOs may result in restrictions on COD eligibility and may require prepaid payment for future purchases.

15. INTELLECTUAL PROPERTY

All KAALVOID intellectual property, including but not limited to:

KAALVOID name and logo.
Brand elements.
Product photographs.
Graphics and artwork.
Website design.
Product descriptions.
Text, videos, and other original content.

is owned by or licensed to NDS Digital Private Limited, unless otherwise stated.

Nothing on the Website grants a Customer ownership rights in any KAALVOID intellectual property.

You may not copy, reproduce, modify, distribute, publish, sell, commercially exploit, or otherwise use KAALVOID intellectual property without prior written authorisation.

16. USER REVIEWS AND CONTENT

Customers may have the opportunity to submit reviews, ratings, photographs, comments, or other content.

By submitting such content, you represent that:

You have the right to submit it.
It does not unlawfully infringe another person's rights.
It is not fraudulent, misleading, defamatory, abusive, or unlawful.

KAALVOID may moderate, remove, or refuse to publish content that violates these Terms or applicable law.

Any rights granted to KAALVOID in relation to customer-submitted content will be subject to the terms disclosed when that content is submitted and applicable law.

17. PRIVACY AND PERSONAL DATA

KAALVOID may collect and process personal information required to operate the Website, process orders, facilitate payments, provide customer support, deliver products, prevent fraud, and perform other legitimate business functions.

Such processing will be governed by the KAALVOID Privacy Policy and applicable law.

The Privacy Policy forms part of these Terms.

18. THIRD-PARTY SERVICES

KAALVOID may use third-party service providers for functions such as:

Payment processing.
Shipping and logistics.
Website infrastructure.
Customer communications.
Analytics and other technical services.

Third-party services may be governed by their own terms and policies.

KAALVOID will take reasonable steps in selecting and using service providers but is not responsible for independent acts or omissions of third parties beyond its reasonable control.

19. FORCE MAJEURE

KAALVOID will not be responsible for delays or failure to perform obligations caused by circumstances beyond its reasonable control, including natural disasters, extreme weather, war, government restrictions, strikes, widespread technical failures, cyber incidents, pandemics, logistics disruptions, or other similar events.

Where reasonably possible, KAALVOID will take appropriate steps to minimise the impact of such events on Customers.

20. LIMITATION OF LIABILITY

To the extent permitted by applicable law, KAALVOID shall not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Website or services.

Nothing in these Terms is intended to exclude or limit any liability or consumer right that cannot legally be excluded or limited under applicable law.

Where liability may legally be limited, KAALVOID's liability will be determined in accordance with applicable law and the circumstances of the relevant transaction.

21. SUSPENSION OR TERMINATION

KAALVOID may restrict or suspend access to the Website or refuse future transactions where there is reasonable evidence of:

Fraudulent activity.
Payment abuse.
Repeated COD refusals or RTOs.
Misuse of promotions.
Website abuse.
Intellectual-property violations.
Other serious violations of these Terms.

Such action will not affect rights or obligations that have already accrued under applicable law.

22. CHANGES TO THESE TERMS

KAALVOID may update these Terms from time to time to reflect changes in its business, services, technology, policies, or applicable legal requirements.

The updated version will be published on the Website with a revised Effective Date or Last Updated date.

Your continued use of the Website after the updated Terms are published may constitute acceptance to the extent permitted by applicable law.

23. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally permissible, and the remaining provisions will continue to operate.

24. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India.

Subject to any mandatory consumer-protection rights and the jurisdiction of legally competent consumer forums or other authorities, disputes shall be subject to the jurisdiction of the competent courts and forums having jurisdiction in Muzaffarpur, Bihar.

I have intentionally worded this as “competent courts and forums” rather than simply “Muzaffarpur District Court,” because consumer disputes can be subject to statutory consumer forums and jurisdiction rules that cannot necessarily be overridden by a website clause. The Consumer Protection Act provides a tiered consumer-dispute framework, including District, State and National Consumer Commissions.
